a.      Security deposits collected may be applied to any damages caused by tenant and it is further agreed that the tenant shall be liable for any unpaid long distance telephone or cable/satellite TV charges that are not specifically described in Agreement as being included with the premises.  The owner will fully account for all deposits and deductions when refunding security deposit returns and will do so within 30 days of tenant departure.

 

b.       No rental agreement will be sent.  Tenant should print this document, and sign and date each page as confirmation of your agreement.  Tenant will need to submit to owner a deposit of 50% of the total gross amount due including tax and security deposit to reserve the requested dates and the remaining balance 30 days prior to occupancy.  This payment may be made by personal check made out & mailed to:

a.       There will be a $30.00 charge for any returned check.  If for any reason the property has already been rented to another party when owners receive the check, owners will promptly return check to Tenant.

 

b.       Any and all interest earned on deposits and advance rents paid will accrue to owners benefit and not the tenant.

 

c.       There will be no refund for inclement weather, except mandatory evacuations.  In the event of mandatory evacuation, the pro-rata share of the rental charge will be refunded.

 

  1. Cancellation by owner:  Owner reserves the right to cancel agreement at any time prior to tenant taking possession of the property.  In such event, all payments made by tenant to owners will be refunded and owners will not be liable for any damages of any sort incurred by tenant as a result of such cancellation.

 

  1. Cancellation by tenant:  Rental deposits will be refunded, less a 15% processing fee if cabin property is re-rented.  No refunds if cabin property is not re-rented. 

 

  1. Date changes by tenant:  Dates of occupancy must be changed 30 days and be in writing.  If approved by owner, original lease will become effective for new dates.

 

  1. Indemnification and hold harmless:  Tenant agrees to indemnify and hold harmless owner from and against any liability for personal injury or property damage sustained by any person (including tenant’s guests) as a result of any cause.

 

  1. Right of entry:  Tenant agrees that owner or their respective representatives may enter the cabin during reasonable hours to inspect the cabin, to make such repairs, improvements or alterations thereto as owners may deem appropriate.

 

  1. Assignment:  Tenant shall not assign this agreement or sublet the cabin in whole or part without written permission of owner.

 

  1. Rules and Regulations:

a.       Check-in time is 3:00PM or after.

b.       Check-out is 11:00AM sharp.

c.       Balance of rent is due 30 days prior to arrival. NO REMINDERS WILL BE SENT.  (For late bookings, an arrangement must be made with owners to facilitate payment before arrival.)

d.       Keys will be provided at the property.  Keys should not be given out to anyone other than the person (s) whose name (s) is on the reservation.  Keys not returned, will be charged a service fee of $25.00 and deducted from tenant’s security deposit.

e.       Lock-outs:  If you lock yourself out of the cabin, please call (828) 266-9008 and arrangements will be made to have a key brought to you.

f.         Maintenance and repairs:  Owners will do their best to keep all equipment in good repair.  If you discover anything not in good working order, please notify owner immediately at (828) 265-4102, and owners will correct as soon as possible.  There will no rebates given due to the malfunctioning or breakdown of appliances, television/VCR/DVD, telephones or any other property equipment or services.

 

 

  1. Accommodation Rules:

a.       Tenant agrees that property will not be used or occupied by more than the maximum allowable number of occupants set forth in this agreement.  Overloading the cabin will result in expedited eviction.

b.       No campfires, campers, ATV’s or tents.

c.       Pets are allowed in this cabin but must be pre-approved.  Pet fee of $50/pet will be applied and is NON-REFUNDABLE.

d.       SMOKING IS NOT ALLOWED IN THIS CABIN.  If any cigarettes or cigars are found around the cabin, an additional cleaning fee will be deducted from tenant’s Security Deposit to pay for removal of such debris or billed for the additional cost.

e.       House parties are strictly prohibited.  Any complaints filed with the County Sheriff’s Department against tenant will result in expedited eviction.

f.         Grilling is only permitted on gravel areas away from cabin.

 

  1. Furnishings:

a.       Bed and bath linens are provided.  All beds have pillows and blankets (additional bed linens & blankets are stored.)

b.       Paper products are supplied in small quantities.  Please replace any used for the next guests.

 

  1. Cabin Maintenance by Tenant:

a.       Keep that part of the property that tenant occupies safe and clean. 

b.       Dispose of all ashes, rubbish, garbage and other waste as directed in cabin.  Under no circumstances is trash to be left on porches or any other exterior location.

c.       Tenant is responsible for any damage incurred during their occupancy of the premises.

d.       The property will be inspected before and after tenant’s departure.  If damage does occur in the cabin, please do not feel embarrassed, but report the damage to us immediately (828) 266-9008.  It is possible we can handle the repair while you are here and alleviate any questions of both parties.

e.       Owners maintain locked closets.  If it is discovered that the owner’s closet has been broken into after tenant’s departure, tenant will be charged the full replacement cost for all items that are missing plus any expenses of repair.

f.         Tenant’s are responsible for the following cleaning before departure: 

i.      Tidy up the cabin and make sure everything is in order as you found it.

ii.      Please make sure all books, games, toys, videos are returned to their proper place. 

iii.      Clean all food out of the refrigerator and cabinets. 

iv.      Wash and put up dishes. 

v.      Lock all doors and windows.

g.       Please drop your garbage off at one of the convenient garbage drops on Highway 221 or 421.

 

This contract is bound upon our receipt and deposit of the renters' first payment.

We are pleased to be able to rent our cabin to you.  We hope you will have an enjoyable and relaxing experience while vacationing in the N.C. Mountains.

 

The undersigned, by signature(s) below, understands and agrees to the terms of this agreement.  This agreement is the full agreement between the Owner and Tenant.
